1. Services Offered

Jo Jo’s Bee Lawn and Tree Service (“Company,” “we,” “us,” or “our”) provides, but is not limited to, the following services:

Tree services (trimming, pruning, removal, and related work)
Lawn care and maintenance
Landscape design and installation
Irrigation system design, installation, and repair
Christmas light installation and removal
Low-voltage landscape lighting
Firewood sales and delivery

All services are performed according to the written estimate, proposal, or agreement approved by the Client.

2. Supplies & Equipment

Jo Jo’s Bee Lawn and Tree Service will provide all necessary labor, supplies, tools, and equipment required to perform the agreed-upon services unless otherwise stated in writing.

3. Tree Services, Phased Work & Cleanup

All tree work includes hauling and chipping of wood debris generated during the process, along with a thorough final cleanup, unless otherwise specified in writing.
Tree work may be completed in phases and may involve two or more crews performing different stages of the project.
Completion timelines are estimates and may extend over two or more days.

4. Tree, Landscaping & Irrigation Risk Acknowledgment

The Client acknowledges that tree work, landscaping, and irrigation services involve inherent risks due to the natural and unpredictable conditions of trees, soil, terrain, underground systems, and weather.

These risks may include, but are not limited to:

Hidden decay, hollow trees, or unstable limbs
Shifting soil, erosion, or compaction
Root disturbance beyond visible areas
Proximity to structures, utilities, and underground systems

By authorizing services, the Client accepts these inherent risks and agrees that Jo Jo’s Bee Lawn and Tree Service is not responsible for damages resulting from conditions beyond reasonable professional control, provided work is performed in a commercially reasonable manner.

5. Underground & Hidden Conditions (Tree, Landscaping & Irrigation Work)

The Client acknowledges that underground and hidden conditions may exist that are not visible prior to the start of work. Tree roots, irrigation components, and landscape installations may extend beyond visible or expected areas and may interfere with:

Underground utilities
Irrigation lines, sprinkler heads, valves, and wiring
Drainage systems
Septic systems
Concrete, asphalt, pavers, curbing, or other paved surfaces

The Client is responsible for identifying and disclosing known underground systems and for ensuring utilities are properly marked.

Jo Jo’s Bee Lawn and Tree Service is not responsible for damage to underground or hidden items that are not properly marked, disclosed, or visible prior to the start of work.

6. Property Protection & Normal Wear

Our crews will take reasonable steps to protect buildings, lawns, and landscaping features. Protective materials may be used where appropriate.

The Client understands that some normal wear and tear may occur due to equipment use, soil conditions, tree removal, or irrigation work, and such wear does not constitute property damage.

7. Client Responsibilities & Personal Property

Clients must remove or secure all personal property from work areas, including but not limited to:

Yard decorations and signs
Lights, grills, tools, or equipment
Trampolines, toys, furniture, or similar items

The Company is not responsible for damage to items left in work areas.

8. Pets & Animals

Clients are responsible for securing all pets.

Work will not be performed on properties with loose animals or animals tied under or near trees or work zones. Unsafe conditions may result in rescheduling or additional charges.

9. Weather Conditions & Scheduling

All services are subject to weather conditions. Rain, extreme heat, freezing temperatures, or other unsafe conditions may delay or reschedule work.

Weather-related delays do not constitute breach of contract.

10. Irrigation Systems & Texas Regulatory Compliance

Irrigation work is subject to existing system conditions and state regulations.

Jo Jo’s Bee Lawn and Tree Service performs irrigation services in compliance with applicable Texas regulations.

11. Right to Refuse or Modify Work

For safety and operational reasons, Jo Jo’s Bee Lawn and Tree Service reserves the right to:

Refuse to perform tree, landscaping, or irrigation work deemed unsafe
Modify the scope, methods, or sequence of work if site conditions change
Stop work if undisclosed hazards, underground conditions, or unsafe circumstances are discovered

Any necessary changes will be communicated to the Client as soon as reasonably possible and may result in additional charges or schedule adjustments.

12. Christmas Lights & Low-Voltage Landscape Lighting

Installation is subject to site access, weather, and electrical conditions. The Company is not responsible for pre-existing electrical issues or Client-supplied materials.

13. Firewood Sales

Firewood is sold as-is. Quantities are estimated by volume. All sales are final upon delivery or pickup.

14. Payment Terms

Payment terms are outlined in the approved estimate or invoice. Late payments may be subject to fees permitted under Texas law.

15. Limitation of Liability

To the fullest extent permitted by Texas law, the Company’s liability is limited to the amount paid for the specific service performed.

16. Indemnification

The Client agrees to indemnify and hold harmless Jo Jo’s Bee Lawn and Tree Service from claims arising from undisclosed hazards, unsafe conditions, or Client negligence.

17. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas.

18. Acceptance

By approving an estimate or allowing work to proceed, the Client acknowledges and agrees to these Terms & Conditions.
